REFUND & CANCELLATIONS POLICY

1. Booking & Membership Confirmation

Your place in classes or membership is confirmed once your payment has been received and accepted.

2. Notice to Cancel

To cancel your membership or class enrolment, you must provide a minimum of 4 weeks’ written notice by emailing info@utopiaactive.co.uk

Your membership will continue, and payments will remain due, until the notice period has ended.

3. Cancellation & Refunds

  • Cancellation by Member:
    Once notice has been submitted and accepted, membership will end after the 4‑week notice period. Fees are not refundable for notice periods already served or for classes attended or unattended during the notice period.
  • Cancellation by Us:
    We will make all reasonable efforts to provide the classes and schedule as advertised. However, we reserve the right to amend, change, reschedule or cancel up to 8% of scheduled classes in any membership period or term due to unforeseen circumstances (including, but not limited to, staff absence, low enrolment, adverse weather, facility issues or other events outside our control). In the event of such changes, we will notify you as soon as reasonably practicable and, where possible, offer an alternative class or session.

4. No‑Shows

Failure to attend scheduled classes does not cancel your membership or affect the notice period, and fees remain due.

5. Direct Debits & Payments

  • All membership fees are collected by Direct Debit or payment method agreed at signup.
  • Cancelling or stopping a Direct Debit or other payment method does not constitute notice of cancellation. Formal written notice by emailing info@utopiaactive.co.uk is required to end your membership.

6. Administration & Late Payment Charges

  • Late Payment Fee (£5): If a payment is not received by the due date, an admin charge of £5 will be applied.
  • Returned Direct Debit / Cancelled Payment (£5): If a Direct Debit or other payment is cancelled, returned, or fails for any reason, an admin charge of £5 will be applied for each occurrence.
  • These fees are in addition to any bank or third‑party charges that may also apply.

7. Outstanding Balances

Any outstanding balances not paid by the due date may be passed to a debt recovery service or pursued through legal action. You agree that we may recover from you all reasonable costs incurred in recovering overdue payments, including administration and third‑party fees. Further charges may be added to the outstanding balance to cover such reasonable recovery costs.

8. Statutory Rights

These terms are additional to your statutory rights under UK consumer law and do not affect those rights where they apply.
